Environmental Group moves NGT to save 200 trees, open space in MIDC Pawane chemical belt

An environmental group has approached the National Green Tribunal (NGT) to prevent a green patch with over 200 trees, located in an open space designated for greenery in Pawane’s MIDC chemical zone, from being used for commercial development.

The Maharashtra Industrial Development Corporation (MIDC) has allotted part of this open space (OS-7) to a Project Affected Person (PAP) for developing a hotel and lodging facility. However, NatConnect Foundation director B.N. Kumar filed an application with NGT’s western zonal bench, arguing that such commercial development violates designated land use regulations.

While expressing support for resettling PAPs, Kumar stressed the need to preserve the green space, suggesting alternative plots for such projects. The 3,600 sq mtr plot, originally leased in 2000 to a chemical company for tree plantation, has been well-maintained since 2001, contributing significantly to combating the region’s high air pollution.

Kumar cited MIDC's Comprehensive Development Control & Promotion Regulations (CDCPR), which prohibit commercial construction in open spaces and limit structures to civic amenities such as water tanks, libraries, or gyms. Additionally, he referenced legal precedents where courts have upheld the preservation of open spaces, deeming them essential for public health and urban sustainability.

The environmental watchdog highlighted the dangers of setting a precedent for altering land use, warning that such decisions could lead to further destruction of green lungs in the pollution-heavy Pawane region. Already, 34 trees are at risk due to the proposed development.

“The trees and green cover are vital for mitigating pollution and protecting nearby residential areas from health risks associated with industrial emissions,” Kumar said.

NatConnect Foundation has urged the NGT to intervene and ensure the preservation of this vital green space, emphasizing that open spaces are essential for maintaining citizens’ fundamental rights under Article 21 of the Constitution.
