In a strong move to curb illegal constructions, the Navi Mumbai Municipal Corporation (NMMC) has issued a 24-hour eviction notice to the owner of a five-story unauthorized building in Shahbaz Village, Belapur division. This action follows heightened scrutiny of unauthorized buildings ahead of the upcoming Maharashtra Assembly elections.
The building in question, which stands just 100 meters away from a collapsed unauthorized structure where three people tragically lost their lives a few months ago, has sparked concern due to its illegal status. Despite ongoing construction and the eventual completion of the building, neither a notice nor an order under the Maharashtra Regional Town Planning (MRTP) Act was issued to the owner by the Belapur Ward Office or the Encroachment Department.
However, the Municipal Corporation has now taken a decisive step, citing violations under Section 53(1)(A) of the MRTP Act, 1966. The notice issued to the building owner highlights that the construction was carried out without the necessary permissions or after the permissions were cancelled. The owner has been given 24 hours to vacate the premises or face eviction by the planning authority.
Failure to comply will result in the NMMC proceeding with demolition at the owner's expense, with costs recovered under Section 53(6)(A) of the MRTP Act, along with potential legal action.
